1. ACCEPTANCE OF TERMS

Welcome to the Yahoo Fire Eagle Service! Yahoo! provides this service to you subject to the following service terms, which incorporate by reference the Yahoo! By checking the box and clicking the "Next" button, and by using and continuing to use the service, you agree to be bound by the Service Terms which include the TOS and the Fire Eagle User Guidelines, and represent and warrant that you are permitted to do so under applicable law.

Where the TOS references the defined term "Service," such terms in the TOS will also apply to the services defined herein to be the "Fire Eagle Service." By using the Fire Eagle Service, you agree that Yahoo! has no responsibility for assessing or resolving any disputes arising from your or another user's use of the Fire Eagle Service. You agree that Yahoo! is not responsible for third party applications that you may use while using the Fire Eagle Service as Yahoo! has no affiliation with such third parties. If you authorize a third party application to access, read and/or write your information, Yahoo! is not responsible for how such information is used by the third party application and cannot guarantee the security of any information that you permit the third party application to access.

The Yahoo! privacy policy does not apply to your use of third party applications. Please read the privacy policy of the third party to learn more about how they treat your personal information.

Yahoo! is not responsible for any unauthorized use of the Fire Eagle Service. You agree that you are solely responsible for payment of any fees associated with your use of or access to third party applications.

3. FEES AND PAYMENTS

Yahoo! reserves the right to charge fees for future use of or access to the Fire Eagle Service, or other Yahoo! services and web sites, in Yahoo!'s sole discretion. If Yahoo! decides to charge fees, such charges will be disclosed to you in advance.
